Please take the time to read and understand these Email Service Terms.
These Email Service Terms govern our provision of and your use of email forwarding and email hosting services that we make available under various Brands at Site Arrow (“Email Service(s)”) including where such Email Services form part of a Product packaged with additional Service(s) from us.
By using or purchasing a Product that includes Email Services, you are entering into a binding Contract with us for such Email Services, and acknowledging that you have read, understood, accepted and agreed to be bound by these Email Service Terms as well as the following:
a) General Terms
b) Acceptable Use Policy
c) Refund Policy
d) Support Policy
All of which are incorporated herein by reference into our Contract with you for the Email Services.
Capitalized terms used and not otherwise defined herein shall have the meanings set forth in the General Terms. In the event of a conflict between these Email Service Terms and the General Terms, these Email Service Terms shall prevail to the extent that it relates to the Email Services.
1. EMAIL FORWARDING
1.1 We offer you email forwarding services which enable you to create email aliases for your domain(s), and automatically forward your incoming emails from such domains to the recipient email address(es) you specify, subject to the limits specified for the Subscription Plan you select.
1.2 You acknowledge that in the course of providing the email forwarding services, your emails will be relayed through servers owned or operated by us and/or our Third Party Provider(s) located in the United States of America, and potentially other jurisdictions.
1.3 You acknowledge that you are solely responsible for ensuring that your emails are properly redirected including by correctly configuring your email forwarding rules (such as setting up forwarders and changing your MX records) by following the instructional guides on our Website(s). We are not responsible for any late or non-delivery of emails to your specified recipient address(es) as a result of your acts and/or omissions, including as a result of the operation of our spam filters or factors and settings beyond our control that may impact email deliverability, including emails being sent to a spam folder or emails not being delivered at all, or IP address blacklisting. You understand that the transmission of emails is never entirely secure and that the entire risk of using email forwarding services remains solely with you.
1.4 You represent, warrant and undertake that you have the right and authority to forward the emails you do using our email forwarding services, and that you do so in compliance with all applicable laws including laws relating to confidentiality and the protection of personal data.
2. EMAIL HOSTING
2.1 You acknowledge that we may act as a reseller of email hosting services from our Third Party Providers.
2.2 When you purchase email hosting services from us, you may be provided with such services from Third Party Provider(s) that we select in our discretion, who will fulfil such services pursuant to their terms and conditions, policies and procedures governing such email hosting services.
2.3 You acknowledge that email hosting services are subject to storage quotas as specified for your Subscription. You agree that we and/or our Third Party Providers may auto-delete email in your trash or deleted folder. We and/or our Third Party Providers may also delete mail in your spam or bulk mail folder automatically. Notwithstanding any automatic complimentary backup services, you are solely responsible for ensuring that you backup and save your emails locally to ensure they will be available when needed. We have no responsibility whatsoever for any emails that may be lost, corrupted, deleted or irrecoverable for any reason.
2.4 You acknowledge that email hosting services do not ensure that your inbound and outbound emails will be delivered as factors and settings beyond our control may impact email deliverability, including emails being sent to a spam folder or emails not being delivered at all, or IP address blacklisting. We have no responsibility whatsoever for any emails that are undelivered for any reason.
3. SUSPENSION AND TERMINATION OF SERVICES
3.1 You acknowledge and agree that in the event of any breach of these Email Service Terms by you, we shall be entitled to take such action as we may deem appropriate against you, including the suspension and/or termination of your Subscription, Account and/or the provision of any Email Service(s) to you, pursuant to the General Terms.
3.2 Without prejudice to the generality of the foregoing and any other rights and remedies which we may have at law or under the Terms of Service, we may terminate or suspend the Email Services forthwith at any time for any cause in respect of which the Third Party Provider of services comprised in the Email Services may terminate or suspend such services under the applicable Third Party Terms.
